Your privacy, and the security of your personal data, is of the utmost importance to us. This Policy transparently describes the information that we gather from you ("you") on the Service, how we use and disclose such information, and the steps we take to protect such information. By using the Service, you consent to the privacy practices described in this Policy. This Policy is displayed on our website, in the mobile application, and in the online marketplace stores.

This Policy sets out the essential details relating to your personal data relationship with the 10-21 service. To better understand this Policy, the following definitions are applicable:

1. The 10-21 Services; Relationship Between 10-21 and Public Safety Agencies

The Company makes available the 10-21 Service to Public Safety Agencies. These are approved Users of the 10-21 service. "Public Safety Agencies" or "User" does not include fire or emergency medical agencies. If you are not a Public Safety professional you are not permitted to use 10-21.

2. Personal Information We Collect

When you use the 10-21 Service, you may provide and we may collect what is generally called personally identifiable information, or personal information, which is information that specifically identifies an individual. For the purposes of this Privacy Policy, we refer to such information as "Personal Information." Examples of Personal Information include name, email address, and mobile phone number. Specifically, 10-21 collects the following information:

  1. Your first and last name
  2. Your agency email address
  3. Your phone number
  4. The public safety agency that you work for
  5. Your rank within the public safety agency
  6. The operating system version on your mobile device
  7. The log of phone calls made from the 10-21 app
  8. The log of callback requests

In addition to the information listed above, to process in-app purchases or monthly subscriptions, we may collect financial information including:

  1. Your billing address
  2. Your payment information, including credit card, bank, or electronic payment system information.

We do not store the financial information once the transaction is completed.

3. How We Collect Personal Information

You may provide us with Personal Information in various ways on the 10-21 Service. For example, you provide us with Personal Information when you register for an account, use the 10-21 Service, make a purchase on the Service, or send us customer service-related requests. You are not required to provide any additional information outside of your agency email address in order to use the 10-21 Service, but if you do, that Personal Information will be subject to this Privacy Policy.

We do not collect, nor do we knowingly permit third parties to collect, personal information about your activities over time and across third-party websites or online services.

Cookies:

When you use the Service, we may send one or more cookies - small text files containing a string of alphanumeric characters - to your device. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Service. Please review your web browser "Help" file to learn the proper way to modify your cookie settings. Please note that if you delete, or choose not to accept, cookies from the Service, you may not be able to utilize the features of the Service to their fullest potential.

We may also automatically record certain information from your device by using various types of technology, including "clear gifs" or "web beacons." This automatically collected information may include your IP address or other device address or ID, web browser and/or device type, the web pages or sites that you visit just before or just after you use the Service, the pages or other content you view or otherwise interact with on the Service, and the dates and times that you visit, access, or use the Service. This information is gathered from all users, and may be connected with your Personal Information.

We may also implement third-party content or advertising on the Service that may use clear gifs or other forms of web beacons, which allow the third-party content provider to read and write cookies to your browser in connection with your viewing of the third party content on the Service. Information collected through web beacons is collected directly by these third parties, and 10-21 does not participate in that data transmission. Information collected by a third party in this manner is subject to that third party's own data collection, use, and disclosure policies.

4. Subscriptions

Subscriptions can be managed in your account settings after purchase, and you may email us to assist in managing your subscription at hello@10-21.com. We do not retain your financial information in connection with your subscription.

A subscription is valid for 30/365 days, depending on the membership selected. Payment for the subscription will be charged to your iTunes App Store or Google Play Store account.

You will be charged for the recurring subscription at the price listed next to your selection within twenty-four (24) hours of the end of the current subscription period ("renewal date"). Your subscription will automatically renew at the end of each period, unless you have turned off the automatic renewal before the renewal date. After payment has been processed for the subscription and any subsequent renewals, you will not receive a refund for any unused portion of a term already paid.

5. How We Use Personal Information We Collect

We use the information we collect on the Service in a variety of ways in providing the 10-21 Service and operating our business. We use the information that we collect on the Service to operate, maintain, enhance and provide all features of the Service, to provide services and information that you request, to respond to comments and questions and otherwise to provide support to users, and to process and deliver entries and rewards in connection with promotions that may be offered from time to time on the Service. For example, we use the information we collect to:

We use the information that we collect on the Service to understand and analyze the usage trends and preferences of our users, to improve the Service, and to develop new products, services, features, and functionality.

We may use your email address and/or other information we collect on the Service (i) to contact you for administrative purposes such as customer service or (ii) to send communications, including updates relating to products and services offered by us. We may use your email address and/or other information we collect on the Service to provide you or your agency with products and services offered by us, or by our parent company. Generally, you have the ability to opt-out of receiving certain promotional communications as described below under "Your Choices."

We may use cookies and automatically collected information we collect to: (i) personalize our Service, such as remembering your information so that you will not have to re-enter it during your visit or the next time you visit the Service; (ii) monitor and analyze the effectiveness of Service; (iii) monitor aggregate site usage metrics such as total number of visitors and pages viewed; and (v) track your entries, submissions, and status in any promotions or other activities on the Service.

We also may use your personal information in other ways for which we will provide specific notice at the time of collection.

We do not sell or otherwise disclose your personal information, except as described in this Privacy Notice. The manner in which we share personal information obtained through the public portions of our website and through the 10-21 Services may differ. 8. Your Rights and Choices

You have certain rights regarding the personal information we maintain about you.

If you receive marketing emails from 10-21, you may opt out or unsubscribe by following the directions provided in the email. Please be aware that if you opt-out of receiving commercial email from us or otherwise modify the nature or frequency of promotional communications you receive from us, it may take up to ten (10) business days for us to process your request, and you may receive promotional communications from us that you have opted-out from during that period. Additionally, even after you opt-out from receiving commercial messages from us, you will continue to receive administrative messages from us regarding the Service.

In addition, you may have certain rights under applicable data protection law to access your personal information held by us. We may charge a fee to meet our costs in providing you with details of the personal information we hold about you, and there may be certain categories of information that we may be unable to, or have no right to, provide.

In addition, in connection with the 10-21 Services, you may, of course, decline to share certain Personal Information with us, in which case we may not be able to provide to you some of the features and functionality of the Service. You may update, correct, or delete your account information and preferences at any time by accessing your account preferences page on the Service. Please note that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.

You may also choose to uninstall our mobile app or otherwise choose to no longer use the 10-21 Services.

9. Children's Privacy

Protecting the privacy of young children is especially important. Our Site or Service is a general audience site not directed to children under the age of 13, and we do not knowingly provide services to children, nor do we knowingly collect Personal Information from children under the age of 13 without obtaining parental consent. If you are under 13 years of age, then please do not use or access the Service at any time or in any manner. If we learn that Personal Information has been collected on the Service from persons under 13 years of age and without verifiable parental consent, then we will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under 13 years of age has obtained an account on the Service, then you may alert us at hello@10-21.com and request that we delete that child's Personal Information from our systems.

10. Operating 10-21 Abroad

The 10-21 Service is hosted in the United States and is intended for Users located within the United States and Canada. If you choose to use the Service from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your Personal Information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Service. By providing any information, including Personal Information, on or to the Service, you consent to such transfer, storage, and processing.

A User may choose to use 10-21 Services outside of the United States, for example in the course of their public safety duties. While operating 10-21 outside of the United States, we may transfer personal information that we collect in a foreign country back to the United States, unless otherwise directed by the User.

11. How We Protect Personal Information/Data Security

10-21 maintains administrative, technical and physical safeguards designed to protect the personal information we maintain against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. However, we cannot guarantee that the measures we maintain will guarantee the security of the personal information. Any transmission of personal information to us is completed at your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

Although we may allow you to adjust your privacy settings to limit access to certain Personal Information, please be aware that no security measures are perfect or impenetrable. We are not responsible for circumvention of any privacy settings or security measures on the Service. Additionally, we cannot control the actions of other Users with whom you may choose to share your information. Further, even after information posted on the Service is removed, caching and archiving services may have saved that information, and other users or third parties may have copied or stored the information available on the Service. We cannot and do not guarantee that information you post on or transmit to the Service will not be viewed by unauthorized persons. If we learn of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. We may post a notice through the Service if a security breach occurs.

12. California Residents - Do Not Track

10-21 does not track its customers over time and across third party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals. Third parties cannot collect any personally identifiable information from 10-21 unless you provide it to them directly.

13. Links To Other Websites

For your convenience and information, we may provide links to websites that are not owned or operated by 10-21. These websites may have their own privacy notices or policies. 10-21 is not responsible for the privacy practices of any entity that it does not own or control.

14. Updates To Our Privacy Notice

When we update this Privacy Notice, we will notify you of changes deemed material under applicable legal requirements by posting a notice on our website through the 10-21 Services. We may also notify you of changes in the Privacy Notice in other ways in our discretion, such as via email or other contact information you have provided.

Any changes to this Privacy Notice deemed material under applicable legal requirements will be effective thirty (30) calendar days following our posting of notice of the changes.
